Hong Kong, China has requested WTO dispute consultations with the United States concerning marks of origin requirements imposed by the US on goods produced in Hong Kong, China. The request was circulated to WTO members on November 3, 2020.
Hong Kong, China is challenging several US legal, regulatory, executive and administrative measures through which goods produced in “Hong Kong” allegedly must be marked to indicate that their origin is “China” for the purposes of the United States’ origin marking requirement.
What is a request for consultations?
The request for consultations formally initiates a dispute in the WTO. Consultations give the parties an opportunity to discuss the matter and to find a satisfactory solution without proceeding further with litigation. After 60 days, if consultations have failed to resolve the dispute, the complainant may request adjudication by a panel.
