European Union appeals second WTO compliance panel ruling in Airbus dispute

The European Union filed an appeal on December 6, 2019, concerning the WTO panel report in the case brought by the EU in “European Communities and Certain Member States — Measures Affecting Trade in Large Civil Aircraft — Recourse to Article 21.5 of the DSU by the EU” (DS316). The report was circulated to WTO members on December 2, 2019.

Parties to a dispute can appeal a panel’s ruling. Appeals must be based on points of law, such as legal interpretation — they cannot re-open factual findings made by the panel. Each appeal is heard by three members comprising persons of recognized authority and unaffiliated with any government. Generally, the Appellate Body has up to 3 months to conclude its report.
